The recent legal battle and proposed settlement concerning the real estate industry has resulted in a large amount of misleading and downright false information. While the proposed settlement does have implications for our local REALTORS® Associations as well as agencies like True North Real Estate, Wisconsin law differs from other states in ways that affect key aspects of the settlement.
A very important point to be made is that there is not, and never has been, a standard commission rate established nationwide, statewide or in a local marketplace. In addition, real estate commissions have always been and will continue to be negotiable. These standard practices benefit the buyer, seller, and agent alike by ensuring that prices are fair and that clients receive the best possible service.
In Door County, as well as all of Wisconsin, real estate licensees are required to use state-approved forms, which already include many of the pro-consumer policies addressed in the NAR proposed settlement agreement. These forms and agreements explain how commissions are earned and how compensation is received or paid to real estate firms cooperating in the real estate transaction. In addition, Wisconsin has encouraged and required written buyer agency agreements for buyer clients for more than 20 years, meaning that another stipulation addressed in the proposed NAR settlement was addressed here many years ago.
